1.Acceptance of Terms
By accessing or using Bakekick ("the Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing the Service. These Terms apply to all visitors, users, and subscribers of the Service, including bakers who use Bakekick to manage their home-based baking businesses.

2.Description of Service
Bakekick is a web and mobile application designed to help home-based bakers manage their baking businesses. The Service includes, but is not limited to, order management, recipe and ingredient tracking, customer communication tools, invoicing, a public baker directory, and a customer-facing order request form.
Bakekick is provided as a subscription-based software-as-a-service (SaaS) platform. We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of material changes where possible.
3.Accounts & Registration
To access certain features of the Service, you must register for an account. When you register, you agree to provide accurate, current, and complete information and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must be at least 18 years of age to create an account. By creating an account, you represent and warrant that you meet this age requirement. You may not transfer your account to another person or entity without our prior written consent.
4.Subscriptions & Billing
Bakekick is offered as a paid subscription with a free trial period. By subscribing, you authorize Bakekick to charge your payment method on a recurring basis at the then-current subscription rate. Subscription fees are non-refundable except as required by applicable law or as expressly stated in these Terms.
You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. We reserve the right to change subscription pricing with reasonable advance notice to subscribers.
5.Acceptable Use
You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Service. You agree not to attempt to gain unauthorized access to any portion of the Service, or any systems or networks connected to the Service.
Prohibited activities include, but are not limited to: uploading malicious code, spamming other users, impersonating other persons, collecting user data without consent, and using the Service in violation of any applicable food safety, cottage food, or business licensing laws. Bakekick does not provide legal or regulatory advice.
6.User Content
By submitting content to Bakekick — including photos, text, business information, product descriptions, and other materials — you grant Bakekick a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with providing and promoting the Service.
You represent and warrant that you own or have the necessary rights to all content you submit, and that such content does not violate any third-party rights or applicable laws. Bakekick reserves the right to remove any content that violates these Terms or is otherwise objectionable.
7.Baker Directory Listings
Active Bakekick subscribers are automatically listed in the Bakekick public baker directory. Your directory listing may include your business name, location, product offerings, photos, and other information you provide in your profile. By subscribing, you consent to the display of this information publicly.
You are solely responsible for ensuring that your directory listing complies with all applicable laws, including cottage food regulations in your jurisdiction. Bakekick makes no representation that listing in the directory will result in any particular level of customer inquiries or orders.
8.Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Bakekick and its licensors. The Bakekick name, logo, and all related marks are trademarks of Bakekick. You may not use these marks without our prior written permission.
Nothing in these Terms grants you any ownership rights in the Service. You are granted a limited, non-exclusive, revocable license to use the Service for its intended purpose during your subscription term.
9.Third-Party Services
The Service may contain links to, or integrate with, third-party websites, services, or software, including payment processors, mapping services, and email providers. Bakekick does not control and is not responsible for the content or practices of any third-party services.
Your use of third-party services is at your own risk and subject to those services' own terms and privacy policies. Bakekick disclaims all liability arising from your use of third-party services.
10.Disclaimers
The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Bakekick does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
Bakekick does not warrant or represent that any information on the Service is accurate, complete, or current. Use of the Service is at your sole risk.
11.Limitation of Liability
To the fullest extent permitted by applicable law, Bakekick and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service, even if Bakekick has been advised of the possibility of such damages.
In no event shall Bakekick's total liability to you for all claims exceed the amount paid by you to Bakekick in the twelve (12) months preceding the claim.
12.Termination
We may terminate or suspend your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or for any other reason.
Upon termination, your right to use the Service will immediately cease. You may export your data prior to termination. We will retain your data for a reasonable period in accordance with our Privacy Policy before permanent deletion.
13.Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email or by posting a prominent notice in the Service. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
We encourage you to review these Terms periodically. If you do not agree to the revised Terms, you must stop using the Service.
14.Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Travis County, Texas.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
